Stupid people don't usually end up on top.

 

He broke the law and knew the consequences. It is time to pay the penalty.

Shane, you are right, I am going off assumptions.

However I would think if he is your dads friend you would have a full story, however anything coming close to facts just seem to be trickling through.

So from the information provided it appears to me that your mate broke the law and got what he deserved.

 

My last comment was more directed at MM85

He is throwing up worksafe legislation, thinking that trumps a quarantine issue. Hah!

Conversation:

Worksafe: You left a workplace unsafe with poison in a fish tank

Fisheries: The person making the complaint illegally imported a prohibited fish which poses a quarantine issue that could devastate the native shrimp populations. We felt little choice but to raid the house with a warrant and kill all fish to ensure nothing could be released into our waterways destroying the local ecosystem.

Worksafe: Ok, however when draining the tank he accidentally swallowed some of the water and this caused him nausea

Fisheries: He is a criminal and we are charging him. He was advised that the tank contained a poison. It was stated in the warrant that any shrimp found on the premise that are not native would be destroyed. The poison used was chosen as it is the least harmful to humans. It was that or arsenic.

Worksafe: Thank you, have a good day

 

You can cry foul all you want, your mate doesn't have a leg to stand on.

as stupid as it sounds i think there could be a case for a smart ass lawyer to succeed and win....

 

quote rediculous example....

 

man breaks into my house and my dog chews him up.... man than gets smart ass lawyer and sues me and wins large pocket of money :)  wheres the common sense the man firstly trespassed on my land then broke into my house with intent to steal rape murder etc... and got chewed by my dog doing his duty guarding myself and the house...

he knowingly broke the law and is stupid - does that void him of being responsible for his actions....seems it well does :) 

 

if the guy involved in this raid has squillions of dollars to spare i think he could well win and then sue for damages , stress and who knows what else... but the fisheries officers in question will not lose their jobs or have to pay for the bill.. they are protected by law as fair or unfair as it may seem... the govt simply picks up the tab and then increases taxes the following year to cover it... so then we all pay :(

 

our laws and court system are such a joke... girl got pack raped in sydney... goes to court and lawyers say the offenders donot have to be punished because in their country its the womens fault she got raped...  they didnt know it was an offence in australia.. and get this the judge sentences them to 4 years jail each with non-parole period of 12 months...what a joke... if it was australian born offenders they would of all gotten 15 years with ten year no paroll period... these rapists will all be back on the street in 12 months... that poor girl that got raped... her life is ruined and can never be repaired... mental damage must be immense....

 

ooops getting off track sorry... 

i think there is opportunity to sue and win his case against fisheries... but do you really win in the end? i dont think so... just shut up and take it on the chin... and get on with it.... whatever it may be :)
